Servicemembers Civil Relief Act

The Servicemembers Civil Relief Act (“SCRA”) is a law designed to provide servicemembers (and in some cases, their dependents) with certain benefits and protections against certain legal or financial transactions that may adversely impact their rights while they are performing military or other uniformed service. Under the SCRA, servicemembers are defined as members of the United States Army, Navy, Marine Corps, Air Force, Coast Guard, and Space Force; members of a Reserves component of a military branch; members of the National Guard serving on federal active duty; and commissioned officers of the Public Health Service and the National Oceanic and Atmospheric Administration.

Amongst the benefits and protections provided by the SCRA to servicemembers (and in some cases, their dependents) are:

  • The right to cancel a residential lease without being charged early termination fees,
  • Protection from being evicted without a court order, and
  • Protection from having a default judgment filed against them when they cannot appear in court.

To qualify for the benefits and protections mentioned, the servicemember tenant must be on active duty (for National Guardsmen, active duty is defined as a federal call to order for greater than 30 days).
For lease terminations, the servicemember tenant must provide a copy of their military orders and a written notice of termination to the Property. These can be submitted via email at info@redsailpm.com or by telephone at 757-550-1171.
